This Privacy Policy explains how MediaSpark (“The MediaSpark,” “we,” “our,” or “us”) collects, uses, shares, and protects personal information when you visit our website at themediaspark.com (the “Site”), contact us, subscribe to our newsletter, or otherwise interact with us. We are a marketing agency headquartered in Omaha, Nebraska.
We are committed to handling your personal information transparently and responsibly. If you have any questions about this Policy or our privacy practices, you can contact us at [email protected].
This Policy describes how we handle personal information about visitors to our website, prospects, newsletter subscribers, and people who otherwise interact directly with MediaSpark. In this context, we act as the “controller” of your personal information.
Separately, in the course of providing marketing services to our clients, we may handle personal information on their behalf. When we do so, we act as a “service provider” or “processor.” Our handling of that data is governed by our written agreements with each client (typically including a Data Processing Addendum), not by this Policy. If you are a customer of one of our clients and have a privacy question or request related to that client’s data, please contact the client directly. We will work with the client to support your request as required by our agreement and applicable law.
We collect information you give us when you fill out a form on our Site, contact us by phone or email, or sign up for our newsletter. This typically includes:
When you visit the Site, certain information is collected automatically by the analytics, advertising, and infrastructure tools we use. This typically includes:
We may receive information about you from third parties, such as advertising platforms (Meta, Google, LinkedIn) reporting on the performance of our campaigns. This information is generally aggregated or pseudonymous.
We do not knowingly collect personal information from children under the age of 13. If you believe a child under 13 has provided us with personal information, please contact us at [email protected] and we will delete it.
We do not handle Protected Health Information (PHI) covered by the Health Insurance Portability and Accountability Act (HIPAA) on our own website. We do not handle nonpublic personal information covered by the Gramm-Leach-Bliley Act (GLBA) on our own website.
We use the personal information we collect for the following purposes:
We do not sell your personal information for money. However, our use of advertising and analytics technologies (described in Section 5) may constitute “sale” or “sharing” under certain US state privacy laws, because we share data with these providers to support targeted advertising. You can opt out of this sharing at any time using the methods described in Section 8.
We share personal information in the following circumstances:
Service providers and processors: We use third-party vendors to operate our business, including our customer relationship management platform, our website host, our email service, our advertising and analytics providers, and similar tools. These vendors are contractually limited to using your information only as needed to provide services to us.
Advertising and analytics partners: We share certain information with platforms such as Meta, Google, and LinkedIn to measure and target advertising. See Section 5 for the specific tools in use and Section 8 for your opt-out rights.
Legal and safety reasons: We may share information if required by law, in response to lawful requests from public authorities, to protect our rights or the rights of others, or in connection with an investigation of suspected fraud or other wrongdoing.
Business transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.
With your consent: We may share your information with third parties when you direct us to do so.
We use a number of third-party tools on our Site to operate the Site, measure traffic, and conduct advertising. The current list of tools is below.

| Google Analytics 4 | Google LLC | Measures Site traffic and user behavior, including form submissions and phone-number clicks |

| LinkedIn Insight Tag | LinkedIn Corporation | Measures advertising performance and supports targeted advertising on LinkedIn |
| Google reCAPTCHA | Google LLC | Protects forms from spam and automated abuse |
| Cloudflare | Cloudflare, Inc. | Provides content delivery, performance optimization, and security |

For a detailed list of cookies, including category, duration, and provider, please see our Cookie Policy.
Most non-essential tracking is loaded only after you provide consent through our cookie consent banner. You can change your consent preferences at any time using the consent management tool on the Site.
We retain personal information for as long as we have a legitimate need to do so, including to provide you with the information or services you have requested, to comply with legal obligations, and to resolve disputes. Our default retention periods are below.
| Type of information | Retention period |
| Inbound contact form leads (where no business relationship develops) | 24 months from last interaction, then deleted or anonymized |
| Newsletter subscribers | Until you unsubscribe, plus 30 days for processing |
| Former or closed client contacts | 7 years (matches typical contract and accounting retention) |
| Job applicant data (if applicable) | 12 months |
| Server, security, and analytics logs | Per the default retention of the underlying provider, typically 14 to 90 days |
We may retain information for longer where required by law, where there is a legitimate business reason (such as ongoing legal claims), or where we have de-identified or aggregated the data such that it can no longer be linked to you.
We use reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encrypted connections (HTTPS) on the Site, access controls on our systems, and contractual security commitments from our service providers.
No system is perfectly secure. We cannot guarantee the absolute security of any information transmitted to us or stored by us, but we work to protect it appropriately.
Depending on the state where you reside, you may have some or all of the following rights with respect to your personal information:
To submit a request, email us at [email protected]. We will need to verify your identity before fulfilling certain requests, typically by confirming the email address you used to contact us.
We will respond to verifiable requests within the timeframe required by law (generally 45 days for US state laws, with the possibility of a 45-day extension if the request is complex). We do not charge a fee for handling a privacy request unless it is excessive, repetitive, or manifestly unfounded.
If we deny your request, we will explain why. In states that provide an appeal right, we will tell you how to appeal.
You may use an authorized agent to submit a request on your behalf. We will require written proof of the agent’s authorization and may need to verify your identity directly.
We honor the Global Privacy Control browser signal as a valid request to opt out of the sale or sharing of personal information. If you have GPC enabled, our Site will treat your visit as an opt-out for the browser and device you are using.
The MediaSpark is based in the United States and our Site is directed at US-based businesses. We do not currently market to or solicit business from individuals located in the European Union, the United Kingdom, Canada, or other jurisdictions outside the United States.
If you are located outside the United States and choose to interact with us, your information will be transferred to and processed in the United States. The data protection laws of the United States may differ from those of your country. To the extent the General Data Protection Regulation (GDPR), UK GDPR, or other non-US privacy laws apply, you may have additional rights, including the rights of access, rectification, erasure, restriction, portability, and objection. To exercise these rights, contact us at [email protected].
Our Site does not respond to traditional “Do Not Track” (DNT) browser signals, because there is no industry standard for how to interpret them. We do, however, honor the Global Privacy Control (GPC) signal as described in Section 8.4.
Our Site may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any websites you visit.
If you receive marketing emails from us, you can unsubscribe at any time by clicking the unsubscribe link at the bottom of any email or by emailing us at [email protected]. We honor unsubscribe requests promptly.
We may update this Policy from time to time. When we do, we will update the “Last updated” date at the top of the Policy. If we make material changes, we will provide additional notice (such as by posting a prominent notice on our Site or, where required, contacting you directly).
